Terms of Use

The following terms and conditions (the "Terms") govern your use of the Ellygent systems engineering platform (the "Ellygent Platform") provided by Ellygent (the "Company"). By using the Ellygent Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Ellygent Platform.

1. Prototype Notice
Ellygent is currently provided as a prototype / proof-of-concept personal project. Features, availability, data models, and security controls may evolve rapidly. You should not rely on uninterrupted availability, long-term storage, or production-grade service levels.
2. Limited License
The Company grants you a limited, non-exclusive, non-transferable license to use the Ellygent Requirements for the sole purpose of evaluating its functionality and suitability for your needs. You may not use the Ellygent Requirements for any other purpose, including but not limited to commercial use, without the prior written consent of the Company.
3. Your Content
You may provide input to the Services ("Input"), and receive output generated and returned by the Services based on the Input ("Output"). Input and Output are collectively "Content." As between the parties and to the extent permitted by applicable law, you own all Input, and subject to your compliance with these Terms, Ellygent hereby assigns to you all its right, title and interest in and to Output.
4. Proprietary Rights
The Ellygent Requirements and all intellectual property rights related to it, including but not limited to patents, trademarks, trade secrets, and copyrights, are owned by the Company or its licensors. You shall not use the Ellygent Requirements for any purpose other than as expressly permitted by these Terms.
5. Data Protection and Privacy
We process personal data only as needed to operate accounts, secure access, and improve the prototype. You should avoid uploading sensitive personal data unless necessary for your own testing purposes. If you are located in the EU/EEA, you may request access, rectification, erasure, restriction, objection, and data portability rights where applicable by contacting us through the contact page.
6. Security and Retention
We apply reasonable technical and organizational safeguards for a prototype service, but no internet service can be guaranteed fully secure. Data retention periods may change while the prototype evolves, and we may delete inactive or test data to maintain service quality and cost control.
7. Disclaimer of Warranties
The Ellygent Requirements is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. The Company makes no representation or warranty that the Ellygent Requirements will meet your requirements or be free from errors or defects.
8. Limitation of Liability
The Company shall not be liable for any damages arising out of or in connection with your use of the Ellygent Requirements, including direct, indirect, incidental, special, or consequential damages.
9. Price Changes
We may change our prices by posting notice to your account and/or to our website. Price increases will be effective 14 days after they are posted.
10. Indemnification
You shall indemnify and hold the Company harmless from any claims, damages, losses, and expenses arising out of your use of the Ellygent Requirements or violation of these Terms.
11. Compliance with EU Laws
You shall comply with all applicable EU laws, including the GDPR and the Cybersecurity Act, while using the Ellygent Requirements.
12. Termination
The Company may terminate your license to use the Ellygent Requirements at any time and for any reason. Upon termination, you must immediately stop using the Ellygent Requirements.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union.
14. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding the use of the Ellygent Requirements.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
